The Website is provided "AS IS" and "AS AVAILABLE" without any representation or endorsement and without warranty of any kind, either express or implied, including but not limited to implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security, and accuracy.
To the extent permitted by law, mymate.lk will not be liable for any indirect or consequential loss or damage (including loss of business, opportunity, data, profits) arising from the use of the Website.
We do not warrant that the functionality of the Website will be uninterrupted or error-free, that defects will be corrected, or that the Website or the server that makes it available are free of viruses or anything else harmful.

Availability and Inconsistency in the System

mymate.lk does not guarantee that the system will be available without interruption and will always be error-free, and shall not be liable for any damages caused by such interruptions or errors.
mymate.lk is not responsible for any damages or losses caused to your computer as a result of using the Website.
mymate.lk is not liable for any error or inconsistency of information with other independent systems, specializing in the service provision for GPS, radar, and similar services.

Compensation for Damages

Users agree to indemnify and hold harmless mymate.lk and its representatives from any claims, suits, losses, liabilities, damages, and expenses, including reasonable attorneys' fees and court costs, for damages they cause.
Users agree to indemnify and hold harmless mymate.lk and its representatives from any accidental claims or suits that occur due to driver negligence or fault. Therefore, users agree to indemnify mymate.lk and its representatives from any type of vicarious liability.

Obligations, Liabilities, and Risks for Customers

The customer certifies that they use the service of their own free will and accept full responsibility and risk for using the Website.
The acceptance and denial of service may occur initially by the driver, who can accept or deny the service upon receiving a notification for a delivery. Customers may cancel the contract for any reason. Both recognize that mymate.lk is not liable for any delays, cancellations, failure to cancel the contract, miscommunication between customer and driver, nor for any delay or failure in the delivery of services from the driver.

General Terms and Conditions

Booking and Cancellation Conditions

The User agrees that these terms and conditions apply when using mymate.lk.
mymate.lk shall not be responsible or liable for any loss, damage, or embarrassment suffered by the User due to any instructions or operations effected by the User or purported to be effected by the User, including non-compliance with recorded voice instructions and inability to provide services due to malfunction or failure of any network terminal, data processing system, computer tele-transmission, or telecommunications system.
The User shall not hold mymate.lk liable for any direct or indirect loss or damage which may result from any failure by mymate.lk or any fault of the driver, including if the delivery is not provided at all or within the stipulated time.
The User agrees to indemnify mymate.lk from and against any and all liabilities, losses, charges, and expenses (including legal fees and costs on a full indemnity basis) claims, demands, actions, and proceedings which mymate.lk may incur or sustain directly or indirectly from or by any reason of or in relation to the use or purposed use of mymate.lk and shall pay such sums on demand.

Payment Conditions

The User shall pay the delivery fee (as displayed in the app), parking charges, and additional night surcharge (where applicable) by cash.
If the User does not have sufficient funds to pay the driver after the hire is completed, mymate.lk will be indemnified from and against any and all liabilities, losses, charges, and expenses incurred by the driver or the Company.
If the User is paying through a credit card, standard credit card rules will apply.

Professionalism and Respect

MyMate maintains a zero-tolerance policy regarding all forms of discrimination, harassment, or abuse.

Non-Discrimination

It is unacceptable to refuse to provide or accept services based on a person’s race, religion, national origin, disability, sexual orientation, sex, marital status, gender identity, age, or any other characteristic protected under applicable Sri Lankan law. This behavior can result in permanent loss of access to the MyMate platform.

Inappropriate Behavior

Customers and drivers expect each other to act appropriately and respect boundaries. Derogatory remarks, commenting on appearance, asking overly personal questions, and making unwanted physical contact are all inappropriate behaviors. Soliciting or engaging in sexual conduct while using the MyMate platform may result in loss of access to MyMate. Respect users’ privacy and personal space. Violence of any kind will not be tolerated.

Human Kindness

Calm and clear communication is the most effective way to defuse disagreements. All Customers and drivers expect to be treated with respect and courtesy. This expectation extends to personal property as well.

Safety

The safety of Customers and drivers on the MyMate platform is of utmost concern. To best protect everyone in the vehicle, we require the following:

Compliance with the Law

Illegal substances and, unless explicitly allowed by law, open containers of alcohol are not permitted in drivers’ vehicles. This is against the law and a serious violation of MyMate’s policy. MyMate does not tolerate drug or alcohol use by drivers while using the MyMate app. MyMate prohibits human trafficking of any kind, including the commercial sexual exploitation of children, while using our app. Engaging in such activity may result in loss of access to MyMate. As a driver, it is your responsibility to transport Customers safely according to the rules of the road in your city. Driving when drowsy can cause accidents. If you feel tired, take a break. As a Customer, it is your responsibility to abide by seat belt laws.

Disabilities

MyMate expects compliance with all Sri Lankan laws governing the transportation of riders with disabilities. However, drivers have sole discretion to refuse transportation to Customers with an animal.

Following the Rules

Violations of these Terms could result in the loss of your MyMate account. Please report any violations to MyMate. We want to hear your feedback and take action as necessary.

Termination

Most content and features on the website are available to visitors free of charge. However, mymate.lk reserves the right to terminate access to certain areas or features of the website at any time for any reason, with or without notice. mymate.lk also reserves the universal right to deny access to particular users to any or all of its services without prior notice or explanation to protect the interests of mymate.lk and/or other visitors to the website. mymate.lk reserves the right to limit, deny, or create different access to the website and its features with respect to different users, or to change any features or introduce new features without prior notice.
